Terms and conditions

1 .- ELEMENTS AND GUARANTEES REQUIRED FOR THE IPAD RENTAL

1.1.- Must be of legal age (18 years), possess a valid ID document (national identification card or passport). This document must be written in Portuguese, Spanish or English.

1.2 .- Must possess a valid credit card that has a credit limit equal to or greater than 500 € on the date of the contract and the country where it is signed, as a guarantee. The credit cards are accepted up to the limits allowed by the companies holding them.

1.3. Signature of the rental agreement which contains terms and conditions of rental and general condition of the equipment. This contract will be signed by both parties at the time of delivery of the equipment.

1.4.- LisbonPad strongly recommends that you read all the information regarding the terms and conditions of the rental contained on the website www.lisbonpad.com.

2 .- LISBONPAD´S OBLIGATIONS

2.1 .- LisbonPad must supply to the customer an iPad Wi-Fi + 3G, loaded with at least all the apps listed in the website www.lisbonpad.com with the option of loading the iPad with more apps that weren´t listed on the website.

2.2.- LisbonPad should supply the iPad to the customer in perfect working conditions, as well as a bag to carry the iPad.

2.3.- LisbonPad must be in the delivery place, in the date and time scheduled with the customer.

2.4.- At the end of the rental period, LisbonPad must delivery to the customer a document that confirms that the iPad was delivery to LisbonPad and referring that the deposit fee will be totally released from the customer’s credit card (in case of returning the iPad with no significant damages) or that the deposit fee will be partially released in order to guarantee the costs of the reparation or substitution (in case of no returning the iPad or returning it with significant damages).

3 .- CUSTOMER´S OBLIGATIONS

3.1 .- At the time of signing this contract, the customer should also check the status of the iPad and accessories by completing the section "Delivery status iPad 'in the rental agreement. After this verification, this contract will be signed by both parties (landlord and tenant). To this end, this document with a description of the equipment and accessories, makes part of the rental agreement,

3.2.- The customer must return the iPad in the same state it was delivered on the date of signing the rental agreement, otherwise the customer is responsible for any repair costs resulting from damage presented.

3.3.- The iPad will be delivered to the customer fully loaded with software (described in listing lisbonpad.com). The customer must return the iPad with the same software. Any other software or costs are not included in the rental agreement and are the sole responsibility of the customer.

3.4.- The customer is responsible for taking care of the iPad, keep it in good condition and reimburse LisbonPad for any damages arising from its use.

3.5.- The customer must return the iPad the place, date and time set forth in the rental agreement. LisbonPad only accepts a maximum delay of 15 minutes, after which it will be considered as a non-return case and will charge the entire security deposit.

4.- TERMS OF USE

4.1.- The iPad cannot be used by any user other than the customer or it´s close family members. When using the iPad by minors, it is advisable to have adult supervision since the costs incurred by such use if any damage occur will be the responsibility of the customer who signed the rental agreement.

4.2.- The iPad should only be used in the country where it was rented, being forbidden to use it in any other country. If used in another country, the customer is responsible for paying the charges for the iPad, including roaming charges and other costs associated.

4.3.- The iPad cannot be sub-leased.

4.4.- The customer should not use the iPad in any of the following circumstances: Close to pools, beaches and other places where there is a risk of damage to the device connected with water or sand; Carrying any object that, because of its smell or condition, causes damage to the iPad or results in loss of time or cost to LisbonPad before it can be re-rented. Next to flammable or dangerous objects, as well as toxic, corrosive, radioactive or other hazardous substances.

4.5. The customer cannot bind any accessory that is not subject to prior approval by LisbonPad (unless that is provided by LisbonPad);

4.6.- The customer cannot perform illegal activities or cause damage to equipment, loss of software or breach of security of any computer software or mark as well as utilizing the iPad for illicit purposes.

4.7.- Any use of the iPad that may harm the good name of LisbonPad, gives LisbonPad the right to automatically terminate the rental agreement with immediate effect.

4.8.- If requested by the police or any other official entity, the LisbonPad may transmit personal data of the customer. This transmission will be in accordance with the principles of data protection in the country of rental.

5.- THE RENTAL PERIOD

5.1.- The rental duration is calculated based on indivisible periods of 24 hours, beginning at the time that the iPad is available to the customer. It is permissible a tolerance period of 15 minutes after the end of the rental period described in the rental agreement.

5.2.- If the customer wants to use the iPad for a longer period than what was agreed in the rental agreement, you should contact by email or phone LisbonPad, requesting renewal of the contract in order to extend the duration of the rental period. It is necessary however that the new contract is signed before the rental start a new period.

5.3.- The rental period ends with the return of the iPad to one of LisbonPad’s employees in the date and time scheduled in the rental agreement.

6.- DELIVERY AND RETURN

6.1.- At the time of delivery is signed by both parties the rental agreement in which the customer undertakes to return the iPad to LisbonPad in the defined location, in the date and time indicated in this document.

6.2.- This return must be made to an employee of LisbonPad, properly identified. Under no circumstances can the customer return the iPad to any other person present at the hotel.

6.3.- If iPad is returned without its accessories, the customer must pay the market value of the same date of the return of the iPad.

7.- RATES

7.1.- The total rent will vary according to the published prices on the website (www.lisbonpad.com) at the time of rental. These prices will serve as a reference to the rental agreement. The total value is determined by multiplying the daily rate by the number of days requested.

8.- TERMS OF PAYMENT

8.1.- Payment will be made via a credit card if the reservation is made by www.lisbonpad.com website, or by cash, debit or credit card if the reservation is made by phone or email. This payment is done before they start rental period. However, if the customer decides to pay with cash, it is always needed a credit card, so to be charged the security deposit.

8.2.- This amount will be charged at time of booking on the site www.lisbonpad.com or paid directly to an employee of LisbonPad upon delivery of the iPad.

8.3.- The value of the security deposit, € 500, is fixed and independent of the number of rental days in the contract awarded.

8.4.- Any additional fees associated with differences between the initial booking amount, changing the number of days, iPad damaged or not returned will be charged at the end of the rental period or earlier if deemed necessary LisbonPad.

8.5.- The credit card charge will always be made in Euros. If the Bank has the cardholder associated with other currency, the conversion will be done later, according to the conditions of each bank.

8.6.- The rates for the rental and additional services are those that are effective on the date of booking (if made by the site) or the date of signing the lease agreement. Any changes in the conditions of the reservation may result in a rate change.

9.- REIMBURSEMENT CONDITIONS

9.1- Changes to reservations made and already paid should be reported to LisbonPad within a minimum of 2 days in advance (48 hours of the start of the rental), by e-mail, so that the reimbursement can be made in full to the same credit card used to pay through the Paypal system. For cancellations made after this period described above there will be no refund of amounts already received. In either case, confirmation of the cancellation will be sent to the customer through the e-mail address supplied.

9.2.- There will be no reimbursement of payments made if the customer does not attend the place and time set for the delivery of the iPad, or if the customer have not warned LisbonPad of the change of dates, as established above. The LisbonPad only tolerates delays of 20 minutes, after which it will give the reservation as canceled and will charge for one day rental and provide the equipment to another customer.

10.- THEFT, ACCIDENT/DAMAGE OR CONFISCATION

10.1.- In the case of third parties actions, such as confiscation or theft of the iPad, the customer must immediately inform LisbonPad in writing (by e-mail). LisbonPad will use all legitimate means to secure their rights. You will be responsible for all expenses associated with the acts described above and for any direct, indirect or consequential damages (such as loss) for the iPad, unless it is demonstrated that LisbonPad is directly responsible for the confiscation of the iPad.

10.2.- The rental period will be completed automatically as soon as LisbonPad is informed in writing of the seizure by the competent authorities or by the customer. In the case of theft of the iPad, the rental agreement will end once LisbonPad receive a copy of the theft declaration made by the customer to the police.

10.3.- In either case mentioned above and if this is the desire of the customer and LisbonPad agrees and has availability of equipment, may be provided to hire a new iPad, celebrating a new contract.

10.4.- In both case above where it is explicitly requested the return of the iPad to LisbonPad, and if the customer does not make this return in a maximum of 24 hours, LisbonPad reserves the right to pursue all of the security deposit.

11.- TECHNICAL SERVICES AND MAINTENANCE

11.1.- During the rental period, the customer has at his disposal a service telephone system. This assistance is related to the communication of technical problems within the device and is not intended to resolve questions regarding the functioning of any software or hardware. This assistance is also active and can be provided by email.

11.2.- All communications with the lessor should be made by phone or email to LisbonPad in Portuguese, Spanish and English.

11.3.- If during the rental period the iPad has some problem or accident, the customer must inform LisbonPad by phone or email using the contact details contained in the rental agreement. In these cases, LisbonPad have the option to choose between replacing the iPad or cancel the lease.

11.4.- LisbonPad will not pay any maintenance costs or purchase of accessories associated with the iPad during the rental period. The only entity authorized to perform this type of maintenance is LisbonPad. All repair costs incurred by the customer will not be refunded.

11.5.- The customer must inform LisbonPad of all accidents, damage, problems or malfunctions of the iPad, even those that have already been repaired at the time of returning the iPad.

12 .- INSURANCE

12.1.- LisbonPad is uninsured against physical harm and property that the customer may infringe a third party, resulting from an incident involving the iPad. The customer is 100% responsible for the costs it may incur due to these reasons, as well as any damage inflicted.

13 .- LIABILITY

13.1.- The customer will be liable for any moral or property damages made during the rental period, which are related to the use of the iPad, behaving as if it were the owner of the iPad. LisbonPad is not liable for loss, theft, robbery or damage of any kind related to the rented objects (iPad and accessories).

13.2.- In case of theft, the customer must compensate the LisbonPad for all costs related to the substitution (including repair costs, resale value of the iPad, loss of usability, administrative and other costs). This amount will be 500 €, corresponding to the security deposit made at the beginning of the lease.

13.3.- In case of damage, the customer must compensate the LisbonPad for all costs of repair. This amount is variable and subject to verification of the repair costs of each type of damage. The calculated value of repair will be deducted from the total value of the security deposit made at the beginning of the lease and there will be a partial refund of this deposit.

13.4.- LisbonPad won´t pay any costs relating to the purchase of accessories associated with the iPad, during the rental period.

13.5.- Under no circumstances LisbonPad assume responsibility for personal items that may have been left with the iPad the end of the rental period.

13.6.- The customer is liable for any financial losses that LisbonPad could suffer as a result of breach of contract and for any claims made by third parties. Customer agrees to pay damages that LisbonPad suffers to enforce the terms of the contract, exempting LisbonPad from any liability.

UNDER ANY CIRCUNSTANCES LISBONPAD, OR ANY OF ITS OFFICERS OR EMPLOYEES, WILL BE LIABLE FOR ANY LOSSES, CLAIMS OR LEGAL ACTIONS RELATED DIRECT, INDIRECT OR CONSEQUENTIAL LOSS OF BUSINESS REVENUE ASSOCIATED WITH THE CUSTOMER, AS LOST OF PROFITS OR REVENUES, IN CONNECTION WITH THE USE AND RENTAL OF IPAD. THE CUSTOMER SHALL INDEMNIFY AND ENSURE THAT LISBONPAD DISCLAIMS ANY LIABILITY, DAMAGES, LOSSES OR EXPENSES ARISING OUT OF THE RENTAL AND / OR USE OF THE IPAD.
